And in light of this reality, leaders need to hear from those being led. Leadership is not a one-way street. We do the leader a disservice if we are a worker and we allow the leader to founder. If we allow her to wander into dangerous territory, or to forget the principles that brought her to our attention in the first place, where are we? Now, I find shepherd to be an apt descriptor for yet another reason. They tend to do whatever other sheep do, the flock, the flock of sheep. You know, if you've been a shepherd, you know, if you have a flock of sheep coming along and you hold out a rod, the first sheep to approach that rod will leap over it.

And you will see that, as I go through the tool, the top two levels in the tool were adopted from a tool that has been validated through NCSBN research. After drafting the tool, we began by piloting it with a variety of different matters that come to our attention. And we used and developed inter-rater reliability in order to, as best as possible, to try to establish consistency in the use of the tool. That led to the development of a guide that the investigator can use along with the tool. We made some refinements along the way and were able to add some new content.

Marijuana-Impaired Driving
The report is to educate the public that drugs other than alcohol, including marijuana, are absorbed, distributed and eliminated from the body differently than alcohol. While BAC correlates closely with impairment, there is no such measure (e.g., THC) for marijuana that correlates with impairment. Thus, a BAC-equivalent impairment measure is not possible. It should be noted that alcohol readily passes through the blood-brain barrier (that prevents many harmful substances in the blood from entering the brain). See Figure 1 for a graphic display of this process of absorption and elimination of alcohol (adapted from APRI, 2003). When one compares the effects of consuming alcohol on behavior (balance, coordination, reaction time), attention (divided attention, vigilance), cognition (decision making), and other propensities like risk taking and judgement, one finds that observed impairment in these functions correlates fairly well with alcohol concentration (in the blood or breath).

Subsequently, a 2013 review of data from 37 of 27,993 articles published from 1990-2009 were summarized into 11 aggregated outcomes and found that “Outcomes for nurse practitioners (NPs) compared to medical doctors (or teams without NPs) are comparable or better for all 11 outcomes reviewed.” (Stanik-Hutt, et al., 2013) The recent consensus study by the National Academies of Sciences, Engineering and Medicine, The Future of Nursing, 2020-2030: Charting a Path to Achieve Health Equity, recommends removing barriers to APRN full practice authority.

You know that in the 1800s, a lot of people in medicine were snake oil salesmen. It was a very shady thing about becoming a physician. There were no standards. The Flexner Report is what came about at the early 1900s and started saying, "We have got to have some standards for medical education," and right then, 75% of all medical schools in the country closed because they weren't equipped to be able to do things at that level of standard. That's what happened. So there was...because it was a crisis in their discipline, medicine realized that they needed to go back to the basics of the things that really matter from a virtue standpoint or why it is that we are physicians.

Whoever is injuriously affected by its being disobeyed must see to it. If the State is injured, the State will see to it. But if we make laws for our benefit, the State will not concern itself further than by providing courts of justice. Thus we find that in the best medical laws, the county medical societies are designated as being the bodies who shall bring prosecution for violations of law, and the expenses they incur are to be repaid from the fines. We, if we wish to secure laws, will have to do the same. The only alternative would be to allow some other body of persons to take this trouble off our hands, in return for which service we would place ourselves under their control.

Let's make sure that regulation is a part of the discussion. And we share those things with you as you share with us, and we really appreciate when jurisdictions become aware of legislative initiatives, whether it's a local level or a federal level, bringing those things to our attention is really important. Another thing that the board has done and decisions throughout the year has been approving grants for implementation of the Nurse Licensure Compact as we look at states that need assistance coming onto the Nurse Licensure Compact.
