The enhanced legislation has been well-received: in the 2016 legislative session, 15 states put forth bills containing enhanced NLC language, including several that were not previously part of the NLC. “This is due to the revisions; the enhancements have brought on these new states,” Fotsch explains. “That’s exciting because that was the point of changing it.” The enhanced NLC will become effective when 26 states have either newly joined or made the necessary changes to their existing legislation. As of mid-March, five states had already done so, and bills in 10 other states were making steady progress. Several other states are considering a 2017 proposal.

The Commission may pursue any other remedies available under federal or state law. ARTICLE X Effective Date, Withdrawal and Amendment a. This Compact shall become effective and binding on the earlier of the date of legislative enactment of this Compact into law by no less than twenty-six (26) states or December 31, 2018. After looking at every item in 2010 and 2012, two items showed a significant increase in the number of flagged resid- uals. Figure 7 shows one of the two potentially compromised items that the study discovered. For this item, there were 34 flagged response times, 26 of which (76.5%) were correct. According to Wise and Kong (2005), the accuracy of the rapid- guessing responses should not exceed the level of chance, as this clearly does. The results indicate that the item may have been compromised. An additional examination of the item’s content reveals a long stem with a memorable story, which might add to the ease of knowledge transfer between exami- nees.

Having multistate privileges as part of the NLC changes all of this and can be valuable for faculty. For faculty whose states aren’t in the NLC, contact your legislators and let your voices be heard. Legislators take personal messages from their constituents very seriously, especially when kept factual and succinct. Of the 26 original NLC states, all but one has implemented the current NLC, which was updated and enhanced in 2015 to encourage more states to join. The sole original NLC state that has not implemented the current NLC is Rhode Island. Therefore, Rhode Island is no longer part of the NLC.
